Terms of Service - FocusCoachee

By using the website, apps, and services of FocusCoachee, you agree to these Terms of Service. Please read them carefully.

1. Definitions

In these Terms, the following terms refer to:

Services: All services offered through the website, apps, advertisements, and notifications of FocusCoachee.

Content: All information, text, media (such as images, photos, videos), coaching pages, and other material placed on the Services.

User: Anyone who accesses or uses the Services of FocusCoachee.

2. Acceptance of the Terms

By using our Services, you agree to these Terms, our Privacy Policy, our Cookie Policy, and our Disclaimer and Limitations. If you do not agree, you may not use the Services of FocusCoachee.

3. License and Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services in accordance with these Terms. You must comply with all applicable laws when using our Services.

4. User Account

To use certain Services, you must create an account. You are responsible for providing accurate information and safeguarding your login credentials. FocusCoachee is not liable for damages resulting from unauthorized use of your account.

5. Content and Ownership

You retain ownership of all Content you post on the Services, but you grant us a license to use, store, and display this Content to provide and improve the Services. Coaching pages and organization pages remain the property of FocusCoachee, even if you create or manage them.

6. Responsibility for Content

You are responsible for the Content you share. You warrant that you have all rights to share this Content and that it does not violate the law or the rights of third parties. FocusCoachee reserves the right to remove Content if necessary.

7. Specific Terms for Coaches and Coachees

7.1 For Coaches

The coach is responsible for all content placed in FocusCoachee, including methods, sessions, notes, assignments, and files. When using methods, models, or materials derived from literature or third parties, the coach must provide proper attribution and may not use copyrighted material without the rights holder’s permission. The coach remains fully responsible for guiding their coachees; FocusCoachee is a supportive tool and does not assume any role in the coaching process. The coach must also ensure that all entered data is accurate and up to date and that no confidential information of third parties is shared without consent.

7.2 For Coachees

The coachee uses FocusCoachee solely for personal reflection and participation in a coaching process. All data entered by the coachee remains the property of the coachee. FocusCoachee will handle this data confidentially and in accordance with applicable privacy laws (GDPR). The coachee may request access to or deletion of their data at any time.

7.3 Intellectual Property

The software, standard methods, and texts developed by FocusCoachee are and remain the property of FocusCoachee. Coaches and coachees may only use these elements within the platform and may not reproduce, distribute, or commercially exploit them outside FocusCoachee without prior written consent. Content added by coaches (such as custom methods or notes) remains the property of the respective coach but may be made available by FocusCoachee within the platform to the coachee(s) for whom it is intended.

7.4 Disclaimer

FocusCoachee provides methods and tools to support coaching processes but is not a substitute for professional advice, therapy, or medical treatment. FocusCoachee is not responsible for the content added by coaches or for the way coaches and coachees apply the methods. Use of FocusCoachee is at the sole risk of the coach and the coachee.

8. Privacy and Data Protection

FocusCoachee processes personal data in accordance with the General Data Protection Regulation (GDPR). We take appropriate technical and organizational measures to protect user data. Despite these measures, we cannot guarantee absolute protection against unauthorized access or data breaches.

9. Age Restriction

You must be 18 years or older to create an account with FocusCoachee. If you are under 18, parental or legal guardian consent is required to use our Services.

10. Paid Services

Certain parts of the Services may in the future be subject to fees. If so, the applicable costs, payment terms, and termination options will be clearly communicated at the time of purchase of the specific Service.

11. Changes to the Services

FocusCoachee reserves the right to modify or discontinue the Services at its discretion. We may also limit the use of the Services and remove Content without liability.

12. Termination

You may stop using the Services at any time by deactivating your account. FocusCoachee may terminate your access to the Services at any time and for any reason without prior notice.

13. Limitation of Liability

The Services are provided “as is” without any warranty. FocusCoachee is not liable for indirect, incidental, or consequential damages arising from the use of our Services.

14. Governing Law

These Terms are governed by Dutch law. All disputes arising from these Terms will be submitted to the competent court in the Netherlands.
